Terms of Service
This is the contract between you and Pixcel. It covers every service we sell: on-site IT, remote IT, hosting, domains, design, branding, and retainers. Refunds and cancellations are in this same document. The Privacy Policy is separate. Checking “I agree” on a form is your electronic signature.
1. Who we are
Pixcel is a small creative IT shop in upstate New York. We are not a 24/7 NOC and not your in-house IT department unless you buy a retainer. By using the site, creating an account, booking work, or paying, you agree to these Terms.
2. Accounts
You must be 18+. Checkout requires an account so hosting, retainers, and design stay on one login. You are responsible for the accuracy of what you give us and for keeping credentials secret. We may suspend an account that is abusive, fraudulent, or used to break the law. Appointments may be requested without an account.
3. On-site break/fix
We visit locations within 50 miles of our published shop origin. Labor is billed hourly at the rate on the site, with a one-hour minimum, then whole hours. There is no separate trip or gas fee. An adult must be present. You represent you own the equipment or have authority for us to work on it. Parts and licenses are extra with your OK. We work professionally; we do not warrant that a machine will be repaired or that data will be recovered. You should back up data before we arrive. Cancel at least 24 hours before the window or one hour of labor is due. No-show (no adult, no access) is one hour.
4. Remote IT
Remote work is billed in 30-minute blocks, 30-minute minimum, including a last partial block. We use TeamViewer QuickSupport unless we both agree on another tool. You download it from TeamViewer, you click Allow, you may disconnect at any time, and you type your own passwords. Cancel 24 hours ahead or one 30-minute block is due. If you fail to join or the machine is offline, that block is due. If we fail to appear, it is not billed.
5. Retainers
Care plans are a monthly hour bank. Hours draw in the same increments as walk-up work. Unused hours roll 30 days past the month they were granted, then expire, with no cash value. The current month is not refundable once it starts. Booking is still required.
6. Hosting and domains
Hosting is a private container billed monthly in advance. 30-day rolling backups and manual snapshots are included; vaults cost extra. You own your content and must not use a box for spam, malware, attacks, CSAM, or other illegal use. We may suspend a threatening box. First-month hosting may be refunded within 7 days if we have not done custom setup; after that the current month is not refunded and we do not prorate. Domains registered through us follow the registrar; once registered they are not refundable by Pixcel.
7. Design
Spark, Signal, and Studio are one-time builds limited to the plan card. Extra work is hourly. You warrant you have rights to the materials you send. After a first draft is delivered, the plan fee is earned. Unused prepaid hours: refundable only within 14 days of purchase if unused; otherwise they expire in 90 days with no cash value.
8. Logo and branding
Mark, Identity, and Kit are one-time branding jobs limited to the plan card. Extra lockups, merch dielines, and motion are hourly. You warrant the name and any supplied marks are yours to use. After a first concept round is delivered, the plan fee is earned. You receive a license to use the delivered final mark for your business when paid in full. Trademark filing is not included. Unused prepaid hours follow the same rule as design.
9. Cancellations and refunds
Prices are USD. Refunds, when due, return to the original method minus non-recoverable third-party fees. Chargebacks without writing us first are a breach. IT: 24-hour cancel free; inside 24 hours or no-show, the minimum increment is due. Hosting: 7-day first-month window as above. Design, branding, and retainers as in sections 5, 7, and 8. This does not limit any non-waivable New York consumer right.
10. Estimates and payment
A booking estimate is not a card charge. The invoice follows time actually used at the published increment. After-hours and same-day add-ons are as quoted. Failed payments may pause work or hosting.
11. No warranty of outcome
Services are provided “as is.” We do not warrant uninterrupted hosting, complete backup coverage, search ranking, or that a problem will not return.
12. Liability
To the maximum extent permitted by law, Pixcel is not liable for indirect, incidental, special, consequential, or punitive damages, or lost data or profits. Our total liability for a service will not exceed what you paid us for that service in the 90 days before the claim. You indemnify Pixcel for claims arising from your content, systems, or breach, except to the extent caused by our willful misconduct.
13. Electronic signatures
Checking an agreement box is an electronic signature under E-SIGN and New York State Technology Law. We store version, time, IP, and browser.
14. Law
New York law governs. Exclusive venue is the state or federal courts covering Pixcel’s principal place of business in upstate New York. You and we waive class actions and jury trial to the extent the law allows.
15. Changes
We may update these Terms. The date at the top is the current version. Work already booked keeps the version you signed unless we both agree in writing.
